This page describes the terms and conditions that govern your enrollment and admittance to all classes and workshops, offered by The Columbia Bartending Agency, Incorporated ("CBA", “us” or “we”).
1. GENERAL RULES AND DEFINITIONS
1.1 If you choose to enroll and/or attend any class offered by the CBA, you will be agreeing to abide by all of the terms and conditions of these Class Policies between you and The Columbia Bartending Agency, Incorporated ("CBA","us", or "we").
1.2 We may change, add or remove portions of these Class Policies at any time, which shall become effective immediately upon posting. It is your responsibility to review these Class Policies prior to each class enrollment and by continuing to enroll and/or attend courses, you agree to any changes.
1.3 YOUR CONTINUED ENROLLMENT AND/OR ATTENDANCE OF COURSES NOW, OR FOLLOWING THE POSTING OF NOTICE OF ANY CHANGES IN THESE OPERATING RULES, WILL INDICATE ACCEPTANCE BY YOU OF SUCH RULES, CHANGES, OR MODIFICATIONS.
1.4 We may change, suspend or discontinue any course or aspect of a course at any time.
2. NON-DISCRIMINATION
2.1 The CBA admits students of any race, color, national origin, and ethnic origin to all the rights, privileges, programs, and activities generally accorded or made available to students at the school. It does not discriminate on the basis of race, color, national origin, and ethnic origin in administration of its educational policies, admission policies, scholarship and loan programs, and athletic and other school-administered programs.
3. CONSUMPTION OF ALCOHOL
3.1 The CBA sets strong expectations that its students and instructors behave in accordance with all applicable laws. Federal law mandates that only persons 21 years or older can consume alcohol.
3.2 Underage students who are found to have consumed alcohol or suspected of consuming alcohol will be immediately expelled from the course without a refund. The studnt will also be indefinitely banned from all further activities with the CBA.
3.3 Students who are of legal age and are found or suspected of assisting underage students consume alcohol will face the same penalties as above.
3.4 The CBA has the sole and final judgment on all issues related to and stemming from unlawful consumption of alcohol. Students cannot appeal this decision.
4. RULES AND REGULATIONS
4.1 You agree to abide by all the rules and regulations as set out by the CBA and its instructors. If you fail to do so, you may be liable to dismissal, therefore not completing any of my courses/workshops, and therefore being refused a certificate(s).
4.2 You understand that, while rare, you may be required to be reschedule your course/workshop start or class date. If you do desire to switch to another course/workshop start or class date you may be able to do so by notifying the CBA in writing, within 48 hours of registering to not incur a penalty.
4.3 You accept that if you do decide to cancel out of my scheduled program/workshop after the 48 hour cancellation period, you will not be entitled to a cancellation refund, only to be reschedule into another start/class date in which a penalty may be incurred .
4.4 You acknowledge that your refund will be processed by the CBA within 30 days after receipt of your written cancellation.
4.5 You agree that if you fail to attend any scheduled course start date that you am not entitled to a refund or rescheduling.
4.6 You acknowledge that you must show any one of the following forms of identification as a primary document in order to attend any of the programs/workshops that require you to be of age to legally consume alcohol. They are as follows: Valid drivers license, Passport, student visa, Citizenship Card. A health card is not an acceptable form of identification. You acknowledge that you also must provide any one of the following forms of identification as a secondary document: A student ID, a credit or debit card, a recent bank statement, a military ID. If a member of the CBA staff feels that my identification is not valid or true, you may be denied entry to the course/workshop. If you fail to present valid identification, you am not entitled to a refund or rescheduling.
4.7 You understand that my enrollment does not guarantee any job positions or placements within the industry you are training for.
4.8 You acknowledge that the CBA is not responsible for any lost or stolen personal belongings that you may bring to any class or purchase from the CBA.
4.9 Any pictures, images or photos taken by The CBA of you while on school premises are now property of the CBA and can be used by the CBA at its discretion without any compensation to you.
4.10 You accept that if you cancel after attending the first of the five classes, you will be entitled to only a partial refund of $150. You also accept that if you cancel after attending two or more of the five classes, you will not receive any refund at all.
5. HOLD HARMLESS
5.1 I, the student, fully understand and accept that bartending can be dangerous activities and that there are substantial risks and dangers that exist due to the very nature of these activities. I understand that these risks and dangers can also exist from latent (unknown) defects in equipment used in all of the foregoing activities. All of the activities involved, directly and/or indirectly, in connection with these activities require me to be in good physical health. I therefore agree to inform, the CBA, in writing, prior to commencement of any training of the afore mentioned activities, of any physical condition that might impair or hamper my participation in these activities (i.e. Heart conditions, sprains etc.) Furthermore, I fully understand and acknowledge that my participation in the activities of bartending and those incidentals thereto could result in injury or illness including but not limited to bodily injury, disease, fractures, strains, partial and/ or total paralysis, death or other ailments that could cause serious disability.
5.2 I hereby assume all risks, dangers and all responsibilities for any losses and/or damages whether caused in whole or in part by the negligence or other conduct of the directors, agents, officers, employees or other students, whether said risks and dangers are foreseeable or unforeseeable. As part of the consideration for services provided by the owner, I hereby release, waive, discharge, hold harmless, defend, and indemnify The CBA, its directors, employees, agents other students from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my participation on the activities arranged by the CBA. This agreement shall be binding upon my personal representatives and my heirs.
